The cancellation of Rajya Sabha candidate Meenakshi Natarajan’s nomination from Madhya Pradesh has sparked a major political and legal controversy. Senior Congress leader and Supreme Court advocate Abhishek Manu Singhvi has termed the Returning Officer’s (RO) decision “illegal and unconstitutional.” According to Singhvi, no criminal case legally existed against Natarajan because the magistrate had not yet taken cognizance of the private complaint filed against her. He explained that under Election Commission rules, candidates are required to disclose only those cases in which charges have been formally framed and where the offense carries a potential punishment of more than two years. Citing Article 324 of the Indian Constitution, Singhvi argued that the Election Commission has the authority to immediately overturn what he described as an erroneous decision by the Returning Officer. The Congress party has also lodged a formal protest before the Election Commission, alleging that the nomination rejection was based on a flawed interpretation of the law.
मध्य प्रदेश से राज्यसभा उम्मीदवार मीनाक्षी नटराजन का नामांकन रद्द किए जाने का मामला अब राजनीतिक और कानूनी बहस का विषय बन गया है। वरिष्ठ कांग्रेस नेता और सुप्रीम कोर्ट के वरिष्ठ अधिवक्ता अभिषेक मनु सिंघवी ने रिटर्निंग ऑफिसर (RO) के फैसले को गैर-कानूनी और असंवैधानिक बताया है। सिंघवी का कहना है कि मीनाक्षी नटराजन के खिलाफ कानूनन कोई आपराधिक मामला दर्ज नहीं था, क्योंकि संबंधित निजी शिकायत पर मजिस्ट्रेट ने अभी तक संज्ञान (Cognizance) नहीं लिया था। उन्होंने स्पष्ट किया कि चुनाव आयोग के नियमों के अनुसार उम्मीदवार को केवल उन्हीं मामलों की जानकारी देनी होती है जिनमें आरोप तय हो चुके हों और जिनमें दो वर्ष से अधिक की सजा का प्रावधान हो। सिंघवी ने संविधान के अनुच्छेद 324 का हवाला देते हुए कहा कि चुनाव आयोग के पास रिटर्निंग ऑफिसर के इस कथित त्रुटिपूर्ण निर्णय को तत्काल निरस्त करने का अधिकार है। इस मुद्दे पर कांग्रेस ने चुनाव आयोग के समक्ष भी विरोध दर्ज कराया है।
