Washing Machine टिप्पणी पर Bombay HC का बड़ा सवाल, क्या नागरिकों को गुलाम बनाना चाहती है सरकार? बॉम्बे हाईकोर्ट ने महाराष्ट्र पुलिस द्वारा एक राजनीतिक कार्यकर्ता के खिलाफ जारी जिला बदर (Externment) के आदेश को सिरे से खारिज करते हुए बेहद सख्त मौखिक टिप्पणी की है.
लोकतंत्र में सरकार की नीतियों का विरोध करने वाले नागरिकों के अधिकारों पर बॉम्बे हाईकोर्ट ने एक बेहद ऐतिहासिक और कड़ी टिप्पणी की है. अदालत ने साफ शब्दों में कहा कि किसी भी नागरिक को सरकार के फैसलों का विरोध करने, धरना देने या शांतिपूर्ण ढंग से नारे लगाने का पूरा अधिकार है. यदि केवल विरोध प्रदर्शन करने के आधार पर पुलिस किसी व्यक्ति के खिलाफ जिला बदर या तड़ीपार जैसी दंडात्मक कार्रवाई करती है, तो यह सीधे तौर पर संविधान द्वारा दिए गए मौलिक अधिकारों का खुला उल्लंघन होगा. इसी टिप्पणी के साथ न्यायमूर्ति माधव जामदार की एकल पीठ ने महाराष्ट्र पुलिस द्वारा सोशलिस्ट डेमोक्रेटिक पार्टी ऑफ इंडिया (SDPI) के महासचिव सईद अहमद अब्दुल वाहिद चौधरी के खिलाफ जारी जिला बदर का आदेश पूरी तरह रद्द कर दिया.
